Terms of Service — Skifty

These Terms govern your use of the Skifty mobile app ("the Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Skifty helps people lend, borrow, give away, and sell physical items within circles — small groups of neighbours, called cirklar in the app. There are two kinds:

  • Private circles are invite-only. You join with an invite code from someone already in the circle.
  • Open circles are listed publicly within the app so that people nearby can find them. An open circle shows its name, its member count, and an approximate area — never a street address — to any Skifty user. Its owner chooses whether people join immediately or must request to join and be approved.

You post items you are willing to lend out, give away, or sell (or that you want to borrow), request items from others, and chat to arrange the loan, sale, or hand-over. A post can be shared to more than one of your circles. If you have chosen to save an approximate area, Skifty can show other members roughly how far away an item is.

Some items are offered as a give-away ("Skänka") rather than a loan. A give-away is a permanent, free transfer of the item to the other user: there is no payment and no obligation to return it. Once an item is marked as given away, the transfer is final as far as the Service is concerned — Skifty does not reverse a completed give-away, and any change of mind is a matter solely between the users involved.

Other items are offered for sale ("Sälja") at a price the seller sets. Skifty shows the asking price on the listing so a buyer knows what is expected, but the sale itself — agreeing the price, paying, and handing the item over — is arranged and completed directly between the buyer and seller, outside the Service. Skifty does not process, hold, or handle any payment, takes no commission, and is not a party to the sale.

Skifty is a platform that connects users. The actual loan, give-away, or sale of an item is an arrangement directly between the two users involved. Skifty is not a party to that arrangement, does not take possession of any item, and does not process, hold, or handle any payment — a sale price is agreed and paid directly between the users, outside the Service. Skifty is not responsible for the condition, safety, legality, price, payment, delivery, return, or any dispute regarding an item that is lent, given away, or sold.

2. Eligibility and accounts

  • You must be at least 16 years old and able to form a binding agreement.
  • You register through our authentication provider (Clerk), either with an email and password or by signing in with Apple or Google. You are responsible for keeping your credentials secure and for activity under your account.
  • If you sign in with Apple or Google, your use of that provider's sign-in service is also subject to their own terms and privacy policies, and you are responsible for keeping that third-party account secure. We are not responsible for the availability or operation of Apple's or Google's sign-in services.
  • One person, one account. Provide accurate information.

3. Acceptable use

You agree not to:

  • Use the Service for anything unlawful, or to buy, sell, lend, give away, request, or offer items that are illegal, stolen, counterfeit, dangerous, or that you do not have the right to sell, lend, or give away — including items you may not lawfully sell or transfer, or that are age-restricted or otherwise regulated, such as tobacco or nicotine products, alcohol, medicines, or weapons.
  • Harass, threaten, defraud, impersonate, or abuse other users.
  • Post content that is illegal, infringing, hateful, sexually explicit, or otherwise objectionable.
  • Use another user's approximate area, or a distance shown in the app, to follow, locate, or turn up uninvited on anyone.
  • Submit false or malicious reports, or use the reporting tools to harass another user.
  • Attempt to gain unauthorised access to the Service, other users' data, or our systems; probe, scrape, or disrupt the Service; or circumvent its security or rate limits.
  • Use the Service to send spam or unsolicited messages.

We have no tolerance for objectionable content or abusive users. We may remove content, restrict access to a circle, and suspend or terminate accounts that violate these Terms — without prior notice where the circumstances warrant it.

4. Reporting, blocking, and moderation

Skifty gives every user tools to deal with content or behaviour they do not want to see:

  • Report. You can report a user, a post, or a circle from within the app. You choose a reason — spam, harassment, inappropriate content, scam, or other — and can add a description, which we ask for if you choose "other".
  • Block. You can block another user from within the app. Blocking takes effect immediately and works in both directions: you stop seeing their posts and they stop seeing yours, and neither of you can send the other a direct message or a request. We do not tell someone that they have been blocked. If you are both members of the same circle, you will still see each other's messages in that circle's group chat — leave the circle, or report the user to us, if that is a problem.

What we do. We review every report. We aim to respond within 24 hours and, in any case, as quickly as we reasonably can — at busy times it may take longer. Depending on what we find, we may remove the content, warn the user, remove them from a circle, or suspend or terminate the account. We may also act on content we become aware of in other ways. We do not guarantee a particular outcome or response time, and we may decline to act on reports that are unfounded or made in bad faith.

You never have to wait for us. Blocking is immediate and does not depend on our review: if someone is bothering you, block them and their posts and their direct messages disappear from your app straight away.

5. Your content

You retain ownership of the content you create (posts, photos, messages). You grant Skifty a limited, non-exclusive licence to host, store, and display that content within the Service to the users entitled to see it — the members of the circles you share it with, and the parties to your chats — solely to operate the Service.

You are responsible for your content and confirm you have the right to share it. Messages and posts are visible to the relevant other users by design (see the Privacy Policy). If you share a post to an open circle, the users entitled to see it include anyone who joins that circle. Do not share anything you would not want those users to see.

6. Open circles, location, and meeting other people

Open circles are not private. Any Skifty user can find an open circle and, depending on the setting its owner chose, join it immediately or ask to join. Once someone is a member, they can see the posts, photos, display names, and avatars in that circle. Do not post anything in an open circle that you would not want someone you do not know to see.

If you own a circle, you decide who is in it. For a private circle that means who you give the invite code to; for an open circle set to approval, who you approve. When someone asks to join, you see their display name and profile picture so that you can decide.

Location is optional and approximate. You choose whether to save an area at all. Skifty stores an approximate area — roughly a 150-metre cell — and never your exact position or address; see the Privacy Policy. Distances shown in the app are approximate and provided for convenience only. Do not rely on them as an accurate or safe indication of where anyone or anything is.

Meeting other people. Loans and give-aways are arranged and carried out directly between users, and in an open circle that may include people you do not know. You are responsible for your own safety: choose where and how you meet, and share your address or other personal details only if you choose to. Skifty does not vet, verify, or carry out background checks on users, and is not responsible for what happens when users meet or exchange items.

7. Transactions between users — no warranty

The Service is provided "as is" and "as available", without warranties of any kind to the extent permitted by law. Skifty does not guarantee that an item offered is available, suitable, safe, or as described, nor that a loan will be honoured, an item returned, a give-away completed, or a sale paid for or delivered. Any agreement to lend, borrow, give away, buy, or sell an item is solely between the users involved. A give-away is a permanent, free transfer with no obligation to return the item; once completed it is final as far as the Service is concerned (see §1). For a sale, the price, payment, and delivery are agreed and completed directly between buyer and seller: Skifty is not involved in the payment and does not guarantee that a buyer will pay, that a seller will deliver, or that an item is as described or fairly priced. Resolve disputes between yourselves; Skifty is not obliged to mediate and is not liable for the outcome.

Nothing in these Terms limits rights you have as a consumer under mandatory Swedish or EU law.

8. Notifications

The Service can send transactional push notifications (e.g. a new message or a request update). These are not required for the Service to function, contain no sensitive content, and you can turn them off in your device settings.

9. Termination and deletion

You may stop using the Service and delete your account at any time, from within the app (or by emailing hello@acoid.com if you can no longer access the app). Deletion removes your data as described in the Privacy Policy §7. We may suspend or terminate your access for violations of these Terms, including under §4.

10. Limitation of liability

To the maximum extent permitted by law, Skifty and Acoid are not liable for indirect, incidental, or consequential damages, or for any loss, damage, injury, or dispute arising from a loan, give-away, or sale arranged through the Service, from items lent, borrowed, given away, bought, or sold between users — including any non-payment, non-delivery, or dispute over price or condition — or from any interaction between users that begins on the Service. This does not exclude liability that cannot be excluded under applicable law (including liability for death or personal injury caused by negligence, or mandatory consumer rights).

11. Changes to the Service and these Terms

We may change or discontinue features, and we may update these Terms. For material changes we will provide notice in the app. Continued use after changes take effect means you accept the updated Terms. If you do not accept a change, you can stop using Skifty and delete your account at any time (§9) — you are never locked into a version of these Terms you did not agree to.

12. Governing law and disputes

These Terms are governed by the laws of Sweden, without prejudice to mandatory consumer-protection rules of your country of residence. Disputes are subject to the courts of Sweden, subject to any mandatory consumer forum rules.

If you are a consumer in Sweden and we cannot resolve a complaint between us, you can refer it to Allmänna reklamationsnämnden (the National Board for Consumer Disputes, arn.se). If you are a consumer elsewhere in the EU, you can contact your national alternative-dispute-resolution body, or the European Consumer Centre in your country.

13. General

  • Severability. If any part of these Terms is found to be invalid or unenforceable, the rest stays in force, and the invalid part applies to the greatest extent the law allows.
  • No waiver. If we do not enforce a right under these Terms straight away, we have not given it up.
  • The whole agreement. These Terms and the Privacy Policy are the agreement between you and us about the Service, and replace any earlier version. This does not limit any rights you have under mandatory consumer law, and does not exclude our responsibility for anything we have told you that turns out to be untrue.
  • Transfer. You may not transfer your rights under these Terms to someone else. We may transfer ours to a company that takes over the Service, provided your rights under these Terms are not reduced.
